OCR REVIEWS

Members would be aware that the RTBU intended on referring the outstanding OCR dispute to Fair Work Australia to have the impasse between the parties arbitrated. This decision was not taken lightly given that decisions of the commission can have wide ranging implications on the entire workforce if they do not fall in your favour.

Following further negotiation with RailCorp, the RTBU have been able to secure most Station Manager/Duty Manager grades by having RailCorp agree on the specific parameters of the dispute. 

Category 1: Stations where RailCorp say there is to be no grade change will not be reviewed unless the Station Manager specifically requests a review -  (Agreed). 

Category 2: Stations that have had a major infrastructure change will be reviewed -  (Agreed). 

Category 3: Outstanding Stations that RailCorp wish to review that do not meet any other criteria - (Outstanding). 

A list of the above are attached and members are requested to identify any errors or omissions and email them to nswho@rtbu-nsw.asn.au. 

The RTBU have met with RailCorp and have put forward a proposal that will settle the outstanding Category 3 matters and will allow the reviews to go ahead:

  1. The reviews are conducted on a without prejudice basis and will not be used in any subsequent commission hearing to support RailCorp’s case.
  2. A panel consisting of the Chief Operating Officer and Union representatives hear any disputes that arise from all OCR reviews.
  3. The Unions can still refer the matter to Unions NSW and/ or Fair Work Australia if they believe the outcome is unfair or incorrect.

RailCorp have made a commitment to respond to the RTBU’s proposal in the coming days.
